Terms & Conditions

Please read our Terms and Conditions carefully.

It is a condition of us permitting you access to our facilities and/or purchasing a membership and/or participating in any class that you agree to our Terms and Conditions. By making a purchase or entering our facilities you are automatically agreeing to our Terms and Conditions. If you do not agree with these Terms & Conditions, you should not make a purchase or enter our facilities.

  1. Our Facilities

  • By attending our facilities and participating in yoga, pilates, barre or equipment class, you will be performing physical activity and exercise which has an inherent risk of personal injury. Participating in all classes is done at your own risk.

  • When attending any class in our facilities we expect you to comply with standard etiquette:

    • arrive with enough time to set up without disturbing others,

    • If entering close to the start time of class, be quiet and considerate of others in the space

    • Remain in the room until the end of class unless using bathroom facilities, or if you need to leave early you must have discussed with the teacher prior to the start time of class

    • If something urgent comes up during class which requires you to leave prior to the end of class, please email info@soulutionyoga.com to let us know about your welfare

    • Place your electronic devices on silent / do-not-disturb prior to the start of class

  • Our live class schedule hosted on Mindbody is regularly updated for both facilities. We reserve the right to cancel any class, change the teacher of any class or change the genre of any class up to the time that the class is due to start. We are not liable to provide a refund, explanation or any compensation whatsoever for classes that are cancelled or changed.

  • If you are not in the class by the start time, your place will be given to another student. No late admittance is permitted under any circumstances, and we strongly discourage you from leaving class early unless there are medical circumstances.

  • You must inform us and our Staff if you have any injury, illness, are pregnant or have any other health concerns before participating in any class or private session. It is your responsibility to complete a new Health Assessment form and Waiver if your health circumstances change in any way. We may refuse entry to class and ask for Medical Clearance from your Health Professional should we have any concerns that you are not fit to attend. We are not responsible for any injuries, loss of property or death that occurs within our facilities.

  • It is your responsibility to maintain current contact information on your account so that we can contact you about class cancellations, changes to terms and conditions or any other relevant communication.

  • The sale of each pricing option is subject to specific terms and conditions applicable to the type of purchase, part of which can include a late cancellation penalties, minimum membership commitment period, automatic direct debit, penalty fees, membership time limitations and/or any membership holds. By purchasing any of our pricing options you are agreeing to the specific and relevant terms and conditions.

  • Our studios are an inclusive environment. Everyone in attendance is required to treat all persons and property at the studios with care and respect. If you behave in a way that does not demonstrate care and respect for persons &/or property we reserve the right to refuse entry and prohibit further attendance at both of our facilities.

  • Any removal of studio property or equipment is strictly prohibited and legal action will be pursued in the event of theft.

  • 12 month members and Direct Debit members mats can be stored on site within the designated areas. These must have your name and a bag/strap to be kept in storage. Any mats without names and a bag/strap can be removed at any time and if not claimed within 14 days will be donated. If you store your mat in the designated area and are not on the appropriate membership your mat will be removed and if not claimed within 14 days will be donated. It is your responsibility if you are storing your mat to do so in a tidy fashion. We are not responsible for any lost or stolen mats, or any damage done to mats. By placing your mat in our storage units you take full responsibility for any damage, loss or theft of your mat.

  • Mobile phones, tablets and laptops are not permitted to be used within the studios at any time. Electronic devices must be stored within a cubby. Any electronic devices on the floor of the studio will be removed. If you are on call or have a circumstance that requires you to potentially be contacted during the class you must receive permission from the teacher and follow instructions about where to place your device, and what to do should you receive a call.

  • We are not responsible in any way for the safekeeping of any of your personal belongings. We encourage you to refrain from bringing any valuable personal belongings to the studios and that you store your personal belongings within eyesight. We are not responsible for any loss or damage to personal belongings you bring to the studios. All personal property must be taken into the studio space and stored in the designated areas. Bags are not permitted to be left on the floor and the space around your mat should be clear. No personal property should be left in reception at any time.

  • Lost property is stored on site in a designated area for a period of 14 days. It is your responsibility to collect your property and the condition of your property is your responsibility. After 14 days lost property is removed from the facility and disposed or donated.

  • Attendance by a minor/under 18 years old is only permitted with a parents completion of the relevant documentation and with parental consent. Parents are responsible for their child’s conduct in class and for the physical wellbeing of their child. We are not responsible for the actions, behaviour or physical wellbeing of any minor.

  • Our facilities house Atlas Sports & Dance Physiotherapy. Entrance into the Physiotherapy treatment rooms is strictly prohibited.

  • We reserve the right to refuse entrance to any person at any time or to eject any person from our facilities at any time. We will refuse entry or eject you in the event that you are under the influence of any substances, behaving in an anti-social, disorderly, aggressive, offensive or dangerous manner or displaying any behaviour that could threaten the security of anyone else within our facilities.

2. Purchases

By purchasing any of our products or pricing options you are automatically agreeing to our Terms & Conditions. We recommend you read the Terms & Conditions in full prior to making any purchase.

ALL Memberships and Class Passes are for personal use only, are Non-Refundable and Non-Transferable.

It is your responsibility to note the expiration date of all purchases. All pricing options activate at the time of purchase.

7 or 10 Day New Student Intro Offer can only be purchased upon your first visit to the studio, and start from that date. Extensions and later date purchases are not permitted.

Starter Month Membership is only available for purchase within 2 weeks of completion of the 7 or 10 Day New Student Intro Offer. Outside of this timeframe regular pricing applies. If these terms are breached we reserve the right to charge you accordingly.

12 Month Memberships can be suspended for a period of a minimum of 1 week and a maximum of 2 weeks up to twice a year, or one hold of 4 weeks.

6 Month Memberships can be suspended for a period of a minimum of 1 week and a maximum of 2 weeks up to once in the duration of membership

Direct Debit Memberships can be suspended for a period of a minimum of 1 week and a maximum of 2 weeks once every 6 month billing cycle. Please make sure you thoroughly familiarise yourself with the contract terms prior to entering a Direct Debit contract.

1 Month & 3 Month Memberships cannot be suspended.

5 and 10 Class Passes cannot be suspended.

All membership suspensions must be submitted in writing. We reserve the right to request medical certificates for medically related suspensions.

Concession pricing is available for FULL TIME Students, those with a pension concession card and military personnel. Proof of concession is required. We reserve the right to charge full pricing rates if you are unable to prove that you are eligible for concession pricing. Part time students are not eligible for concession rates.

3. Penalties

Late Cancellations for reservations made online are subject to a penalty. Once you have a spot reserved in the class you may cancel ONLINE up to 2 HOURS prior to the start time of class without penalty. Early cancelled classes are returned to your account for future use. If you see LATE CANCEL as the only option to cancel out of class, then you are past the 2 hour time frame to cancel and will lose that class from your account. There are no refunds made for payments made so please choose your classes carefully. If you reserve a space in a class and NO-SHOW the same penalty will be assessed and you will lose that class..

Late Cancellation/No Show Penalties:

  • Casual Visit/5 or 10 Class Pass Holders: You will lose the class used to make the reservation

  • Unlimited Membership Holders: You will lose one day off the duration of your membership. If you late cancel 2 or more classes, your online booking will be suspended for 1 week. This includes unlimited introductory trials and starter month passes.

  • PLEASE NOTE: If you make a purchase in order to make your reservation and subsequently cancel prior to the late cancellation window/early cancel, your drop-in/class pass will be returned to your account for future use. Expiration date should be checked for any returned passes.

  • Our system will not process refunds and ALL PURCHASES ARE NON-REFUNDABLE.

Late Cancellation Strike Policy:
For ALL purchase options, if you late cancel 3 times you will have an automatic online booking suspension applied to your account for 7 days. You are still eligible to attend classes, but will be unable to prebook online and will have to contact the studio directly to make a booking, or walk in for a class. Please note that available spaces are not guaranteed for walk in classes.

4. Contracts

Fortnightly Direct Debit Memberships are a Contract with the following terms.

  • Our fortnight Direct Debit contract is for a minimum of 6 months (12 direct debit payments), not including suspension periods.

  • After the initial 6 month commitment the debits will continue as usual unless we is advised in writing (email will suffice) 30 days prior to the contract termination date.

  • Suspensions/cancellations: You must email the studio directly to request any suspensions or cancellation. Minimum suspension is 1 week, maximum 2 weeks and 72 hours notice is required prior to the suspension effective date. There are no backdated or historical suspensions allowed for direct debits. Only 1 suspension is permitted every 6 months.

  • Suspended memberships cannot be cancelled. Your membership must be active for one month prior to cancellation.

  • Early cancellation will result in the client incurring a $140 cancellation fee.

  • For change of account details or lost or stolen cards, please notify us in writing and update your card details within your account.

  • Any and all arrears payments are the responsibility of the client and must be paid in full.

  • Each transaction debited from a bank, credit card, building society or credit union account may incur a transaction fee in addition to the membership price. This transaction fee is your responsibility.

  • Please note that for credit card payments, 'EziDebit' will appear on your credit card statement as the payment reference.

  • Declined or dishonoured payments will incur a fee of $9.90 charged 7 days after the failed transaction. We reserve the right to manually process failed payments at any time including failed payment fees.

Teacher Training Payment Plans are a Contract. It is your responsibility to ensure that you have funds available for any associated transactions. Failed payments will incur a $9.90 fee charged 7 days after the failed payment. Your payment plan may be terminated at any time if there is a breach of agreement, failed payment or missed payment date.

5. Special Events

Workshops & Master Classes

Workshop purchases are non-refundable. In certain circumstances workshop purchases can be transferred to another individual for the same event only. Alternatively a studio credit LESS a $25 administrative fee will be issued to your account if you notify us in writing (info@soulutionyoga.com) at least 72 hours before the start of the event. No other refunds or credits are available under any circumstances.

Teacher Training & Mentorships

SOULution Mentorship Programs and Teacher Trainings are non-refundable. If you withdraw from a Teacher Training 30 days or more before the start date of the training you will receive a studio credit for monies paid minus the non refundable deposit. Once the teacher training has commenced no refunds or credits will be given.

Retreats

SOULution Retreats are a package based trip. If you cancel more than 30 days prior to the retreat you will eligible for a partial refund (minus the expenses of the venue). If you cancel within 30 days of the retreat your booking is entirely non-refundable. Once the event has commenced no refunds or credits will be given.
